These Terms & Conditions ("Terms") govern your use of join.elpasoselect.com (the "Site") and the services offered by Zion 369 LLC d/b/a El Paso Select ("El Paso Select," "we," "us" or "our"), including free business listings, optional paid listing plans and our SMS text messaging program. By using the Site or our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

Use the Site in any way that violates applicable law
Submit false, misleading or unauthorized information, including information about a business you do not own or represent
Attempt to interfere with, disrupt or gain unauthorized access to the Site or its systems
Copy, scrape or reuse Site content for commercial purposes without our written permission
Send spam, harmful code or abusive messages through the Site, chat or text messaging

We may suspend or limit access to the Site or our services for anyone who violates these Terms.

2. Business listings

Our review.

El Paso Select is a curated guide. We may verify, edit for clarity, accuracy, length or style, decline, or remove any listing at our discretion, including listings we cannot verify or that do not fit the guide. Submitting information does not guarantee a listing will be published.

Accuracy.

We work to keep listings accurate and current, but business details change. We do not guarantee that every listing is complete, accurate or up to date at all times.

Owner responsibility.

If you submit or claim a listing, you confirm that you own or are authorized to represent the business, that the information you provide is true and accurate, and that you have the right to share any photos, logos or content you send us. You agree to tell us promptly when your details change.

License to your content.

By submitting business information, photos or other content, you grant El Paso Select a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, display and publish that content in connection with your listing and with promoting El Paso Select. You keep ownership of your content. You can ask us to remove your listing at any time.

No endorsement.

A listing, including one marked Verified, means we confirmed basic business details. It is not a guarantee, warranty or endorsement of any business's products, services or conduct. Your dealings with any listed business are solely between you and that business.

3. Free listing

The El Paso Select Community Listing (our standard listing) is free. We do not charge to create, verify, publish, update or remove a Community Listing. We also offer optional paid plans, currently Local Spotlight and AI Ultimate Exposure. The pricing, billing and plan terms for any paid plan are provided to you before purchase and are agreed separately, and a paid plan is provided only if you choose to purchase it. Your free Community Listing is never conditional on buying a paid plan.

4. Intellectual property

The Site and its content, including the El Paso Select name, logo, badges, design, text and graphics, are owned by or licensed to Zion 369 LLC and are protected by intellectual property laws. You may not use our name, logo or badges without our written permission, except that a business with a published Verified listing may truthfully state that it is listed on El Paso Select. Business names, logos and photos in listings belong to their respective owners.

5. Disclaimers

THE SITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY LISTING INFORMATION IS ACCURATE OR CURRENT.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EL PASO SELECT AND Zion 369 LLC, AND THEIR OWNERS, EMPLOYEES AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, OUR SERVICES, ANY LISTING OR ANY LISTED BUSINESS. BECAUSE THE STANDARD LISTING IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR OUR SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

7. Indemnification

You agree to indemnify and hold harmless El Paso Select and Zion 369 LLC from any claims, damages or expenses (including reasonable attorneys' fees) arising from information or content you submit, your violation of these Terms, or your violation of anyone else's rights.

8. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site or our services will be brought exclusively in the state or federal courts located in El Paso County, Texas, and you consent to the jurisdiction of those courts.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and change the effective date above. Your continued use of the Site or our services after changes are posted means you accept the updated Terms.

10. SMS Program Terms

Program name.: El Paso Select
Program description.: The El Paso Select SMS program sends text messages to people who have opted in, including:

Listing status updates (for example, confirmation that a listing was received, verified, published or updated)

Replies to listing inquiries

Occasional marketing messages about El Paso Select news and offers, such as listing plan offers and local promotions
How to opt in.: You opt in through the chat widget on our website by entering your mobile phone number and checking one or both of two separate consent boxes, neither of which is checked in advance: one for customer care messages (listing updates and replies to your inquiries) and one for marketing messages. Each consent is optional and independent, and providing your phone number alone does not opt you in. By checking a box, you confirm you are the account holder or have the account holder's permission, and that you are 18 or older.
Consent is not required to buy anything.: Consent to receive text messages is not a condition of any purchase or of receiving a listing.
Message frequency.: Message frequency varies.
Costs.: Message and data rates may apply. Check with your wireless carrier for details about your plan.
How to opt out.: Reply STOP to cancel at any time; you will receive one confirmation message. After that, you will not receive further text messages from us unless you opt in again. You may also reply CANCEL, END, QUIT, UNSUBSCRIBE or STOP ALL, or ask us to opt you out by contacting us.

Carrier liability.: Carriers are not liable for delayed or undelivered messages.
Supported carriers.: The program is available on major U.S. wireless carriers. Not all carriers or devices may be supported.
Privacy.: We will not share your mobile number or your text message opt-in data and consent with any third parties or affiliates for their marketing or promotional purposes. For more on how we handle your information, see our Privacy Policy.
Changes to the program.: We may change or end the SMS program at any time. If we make material changes, we will notify subscribers where required.
